Regulation 18 of the Health and Social Care Act 2008 (Regulated Activities) Regulations 2014 is a key piece of legislation designed to ensure the highest standards of care. In Wales, similar requirements are outlined under Regulation 34 of the Regulated Services (Service Providers and Responsible Individuals) (Wales) Regulations 2017, which emphasises the need for sufficient staffing levels and the provision of ongoing training and support to meet the needs of individuals receiving care.

18.—

  1. Sufficient numbers of suitably qualified, competent, skilled and experienced persons must be deployed in order to meet the requirements of this Part.
  2. Persons employed by the service provider in the provision of a regulated activity must—
    1. receive such appropriate support, training, professional development, supervision and appraisal as is necessary to enable them to carry out the duties they are employed to perform,
    2. be enabled where appropriate to obtain further qualifications appropriate to the work they perform, and
    3. where such persons are health care professionals, social workers or other professionals registered with a health care or social care regulator, be enabled to provide evidence to the regulator in question demonstrating, where it is possible to do so, that they continue to meet the professional standards which are a condition of their ability to practise or a requirement of their role.

34.—(1) The service provider must ensure that at all times a sufficient number of suitably qualified, trained, skilled, competent and experienced staff are deployed to work at the service, having regard to—

(a)the statement of purpose for the service;

(b)the care and support needs of the individuals;

(c)supporting individuals to achieve their personal outcomes;

(d)the requirements of the regulations in Parts 3 to 15.

(2) In the case of a care home service where any individual to whom accommodation is provided has been assessed as needing 24 hour nursing care, the service provider must ensure that there is a sufficient number of suitably qualified registered nurses deployed to work at the service at all times.

(3) The service provider must be able to demonstrate the way in which the determination has been made as to—

(a)the types of staff deployed, and

(b)the numbers of staff of each type deployed.

(4) The service provider must ensure that arrangements are made for the support and development of staff.
